The Justice for All Party, tied to Cornel West, is heading to federal court in North Carolina next week in an effort to gain access to the state’s election ballot for the upcoming fall election. The party filed a lawsuit against the State Board of Elections after their bid to be recognized as a political party was rejected in a 3-2 vote by the board. The party is seeking an emergency injunction to force the elections board to certify them as a political party and include their nominated candidate on the November 2024 general election ballot.
The lawsuit alleges that the board did not provide any legal basis for rejecting the party’s bid and cited Democratic operatives’ efforts to keep the new party off the ballot. The party argues that the rejection violates their rights under the First and Fourteenth Amendments of the United States Constitution.
Plaintiffs in the lawsuit are Fayetteville residents who supported the party’s efforts to become a ballot-qualified party. The Justice for All Party has selected Cornel West as its candidate for president and is seeking a court order to certify them as a new party entitled to place its candidates on the ballot. The party’s legal team includes lawyers who have represented Republican legislative leaders in election-related legal battles. The hearing is scheduled for July 30, with a decision requested by August 19 to comply with ballot deadlines for the November election.
