State Treasurer Dale Folwell has voiced his support for the North Carolina Supreme Court’s decision to overturn lower court rulings against a New Bern eye surgeon challenging state healthcare provider restrictions. These regulations mandate providers to obtain a certificate of need (CON) before expanding or purchasing medical equipment. Folwell, responsible for the State Health Plan and taxpayer money, believes these laws are detrimental and anti-competitive.
The surgeon, Dr. Jay Singleton, is contesting the state’s block on him conducting surgeries at his practice. The court directed the case back to a trial judge for reevaluation in light of recent decisions. Singleton argues that these laws force him to refer surgeries to a hospital, costing patients more money and convenience. The court deemed Singleton’s complaint as both a facial and as-applied challenge to the CON laws.
The decision acknowledged that Singleton’s claims could potentially render the CON laws unconstitutional in all applications. As a result, the case will be reassessed by a three-judge panel as required by state law. The John Locke Foundation has shown its support for Singleton’s battle against these regulations.
Folwell’s praise for the Supreme Court’s decision aligns with the ongoing efforts to challenge the constitutionality of these healthcare regulations. The state treasurer’s backing, along with Singleton’s determination to provide more affordable care, sets the stage for a potential reform of the state’s CON laws.
