Former President Donald Trump has stated that if he is re-elected, he would fire Special Counsel Jack Smith, who is currently prosecuting cases against him. This includes a case involving efforts to overturn the 2020 election and another involving taking classified documents when he left office. Trump’s comments have been criticized by legal experts for undermining the independence of the Justice Department. Trump has previously attacked Smith and expressed his intention to dismiss him. This is not the first time Trump has considered firing a special counsel, as he also tried to dismiss Robert Mueller during his first administration. Additionally, Trump has stated that he would use the Justice Department to prosecute his opponents for unspecified crimes. The possibility of Trump firing Smith has raised concerns of potential impeachment proceedings, similar to what happened with President Richard Nixon when he fired Watergate special prosecutor Archibald Cox in 1973. Despite the controversy surrounding his statements, Trump believes that Congress would not impeach him for firing Smith. This comes amid new evidence being released in the election interference case and comments from Trump’s former Chief of Staff John Kelly, who described him as falling into the general definition of fascist.
