Texas House Rejects Bail Amendment for Undocumented Immigrants

Austin, Texas — A legislative push in the Texas House to deny bail to undocumented immigrants faltered Wednesday, as Senate Joint Resolution 1 failed to secure the required two-thirds majority, concluding with a 87-39 vote that fell largely along partisan lines. This marked the second bail restriction proposal to be rejected in as many days, primarily due to united opposition from Democrats.

The failed amendment sought to deny bail specifically to undocumented individuals accused of violent felonies, including capital murder and aggravated assault. Despite attempts by Republicans to address concerns—by excluding certain protected groups like DACA recipients and victims of trafficking—the bill encountered strong resistance from Democratic lawmakers, who argued it would disproportionately impact non-white communities.

Rep. Ramon Romero Jr. (D-Fort Worth), a child of Mexican immigrants, criticized the measure, stating, "It hurts our communities." The bill’s proponents, including Sen. Joan Huffman (R-Houston), framed their argument around public safety, citing incidents of violent crimes committed by undocumented immigrants, and named the proposal “Jocelyn’s Law” in memory of a Houston girl allegedly killed by undocumented individuals.

While tightening bail restrictions has been a priority for Gov. Greg Abbott, his office has not indicated whether the failure of SJR 1 would prompt a special session. However, the Legislature passed a less stringent bail reform package anticipating voter approval in November, designed to keep violent offenders behind bars.

"Governor Abbott looks forward to enacting this package and sending it to voters for their approval," said his spokesman, Andrew Mahaleris, emphasizing the administration’s commitment to enhancing public safety through legislative measures.
